ARIZONA Revised Statutes § 33-992-01 mandate that Subcontractors have up to twenty (20) days to deliver by first class mail or personal delivery a ARIZONA Preliminary Twenty Day Notice to the Owner and all legal parties on a private Commercial project after first furnishing equipment, materials, labor or services. Each day after the 20th day, you lose 1/20 of your financial interest in the financial value of construction related labor, services, equipment or materials your company provided for the project. As an alternative, a Preliminary Notice may be given out at a later point in time, but your financial recovery for a Mechanic’s Lien, if filed, can only be for the twenty (20) day period prior to the Preliminary Notice being filed.

Subcontractors on Owner occupied Existing Residential projects must get a contract with the homeowner PRIOR to first furnishing construction related labor, professional services, materials, machinery, fixtures or tools to a jobsite in order to have future lien rights. If a contract is obtained, ARIZONA Revised Statutes § 33-992-01 mandates that a Twenty Day Preliminary Notice (Private Work) must be delivered by first class mail or personal delivery to all legal parties on a project (Customer, Owner, General Contractor, Lender) within twenty (20) days after first furnishing construction related labor, professional services, materials, machinery, fixtures or tools to a jobsite.

The lien must be recorded within sixty (60) days after a Notice of Completion is filed, or one hundred twenty (120) days after the last day providing equipment, labor, materials or services. It should also be served by First Class mail or personal delivery to all legal parties on a project (Customer, Owner, General Contractor, Lender).

As Claimant you are required to file suit to foreclose on the lien within six (6) months from the date the ARIZONA Mechanic’s Lien was recorded.
