On private Commercial projects MAINE Revised Statutes Annotated Tile 10 § 3253 mandate that a notarized MAINE Lien Statement be recorded by General/Prime contractors and Subcontractors with the Registry Of Deeds in the county where the project was located within ninety (90) days of the last day providing equipment, labor, materials or services for a project. Send by certified or registered mail a recorded copy of the lien promptly to the Owner and any other legal parties for the project (Customer, General/Prime Contractor, Lender/Surety).

A lawsuit to foreclose on the recorded lien must be commenced with the MAINE District or Superior court by the General/Prime contractor within one hundred twenty (120) days of the last day providing equipment, labor, materials or services for a project. Subsequently, a certificate from the clerk of the MAINE District or Superior court documenting that a foreclosure lawsuit was initiated needs to be recorded with the Registry Of Deeds in the county where the project was located within sixty (60) days of the lawsuit being initiated.
