For General/Prime Contractors, a MISSOURI Notice To Owner must be served on the Owner prior to recording a Mechanic’s Lien Statement. Note that it must be given to the Owner prior to receiving payment at the time of the execution of the contract. It can also be given when the materials are delivered, or when the work is commenced.

For Subcontractors, a Preliminary Notice is optional. It can be delivered to the Owner and other legal parties soon after the start of a private Commercial project. On private Commercial projects MISSOURI Revised Statutes §429-100 and §429-110 mandates that ten (10) days prior to recording a valid mechanic’s lien, all Subcontractors must serve to the owner or owner’s agent, or both of them, a Notice Of Intent To File Mechanic’s Lien Statement by any Process Server or officer authorized by law to serve process in civil actions, or by any person who would be a competent witness. Additional copies should be delivered to all legal parties on a project (Customer, General/Prime Contractor, Lender). It must be served within the six (6) month time period allowed for recording a MISSOURI Mechanic’s Lien Statement.
