On private Commercial projects SOUTH DAKOTA Codified Laws § 44-9-50 mandate that General/Prime Contractors can record a SOUTH DAKOTA Notice Of Project Commencement to protect themselves and the project from liens filed by Subcontractors, Sub-subcontractors and subcontractors supplying materials to other Subcontractors.

If a General/Prime Contractor records a SOUTH DAKOTA Notice Of Project Commencement, SOUTH DAKOTA Codified Laws § 44-9-53 mandates that Subcontractors, Sub-subcontractors and subcontractors supplying materials to other Subcontractors must deliver by certified mail to the Owner and General/Prime Contractor a SOUTH DAKOTA Notice Of Furnishing Labor Or Materials no later than sixty (60) days from the last date providing equipment, labor, materials or services for the project.

Subconractors have the optional to deliver a Preliminary Notice to the Owner and other legal parties soon after the start of a project. It is effective in reminding all parties of future Bond, Lien Statement or Stop Notice rights for slow/non payment.
